1. Empire Strong Terms of Use
1.1 - This document sets forth the agreement between Empire Strong's operators and you, hereinafter referred to as "you" or "your", relating to your use of the Empire Strong Exchange. By clicking "I agree" or using any Empire Strong service, you agree to all the terms and conditions stipulated in this Term of Use, as well as our Privacy Policy. In addition, use of certain features of the Services may be subject to specific additional terms and conditions.
1.2 - As with any asset, the values of Digital Currencies can fluctuate significantly, and there is a substantial risk of economic loss when buying, selling, holding or investing in Digital Currencies and their derivatives. By using Empire Strong's services, you acknowledge and agree that: (1) is aware of the risks associated with Digital Currency transactions and their derivatives; (2) shall bear all risks relating to the use of Empire Strong's Services and transactions in Digital Currencies and their derivatives; It is (3) Empire Strong will not be responsible for any such risks or adverse results.
1.3 - By accessing, using or attempting to use Empire Strong's Services in any capacity, you acknowledge and agree to be bound by these Terms. If you do not agree, do not access Empire Strong or use any Empire Strong Exchange services.
2. Account Usage Requirements
2.1 -The Empire Strong account can only be used by the account holder. Empire Strong reserves the right to suspend, freeze or cancel the use of accounts by persons not authorized by the holder. If there is suspicion or knowledge of unauthorized use of the username and password, the holder must immediately notify Empire Strong. Empire Strong assumes no responsibility for any loss or damage arising from the use of the account by the holder or third parties, with or without authorization.
3. User Authentication

3.2 - Empire Strong reserves the right to conduct investigations to verify your identity, either directly or indirectly through third parties. Information that may be collected includes your name, email address, phone number, government-issued ID, and date of birth.
3.3 - It is your responsibility to ensure that the information provided is true, complete and updated in a timely manner. If there is any incorrect, false, outdated or incomplete information, Empire Strong will send a notice to demand correction, being able to delete the relevant information and terminate all or part of the services provided. If Empire Strong is unable to contact you using the information provided, you will be responsible for any losses or expenses incurred by Empire Strong while using the services.
3.4 -By registering, you also authorize Empire Strong to disclose your personal information to credit bureaus and fraud or financial crime prevention agencies, who may respond to our investigations in full. It is important to remember that it is your obligation to update all information if there are any changes.
4. Eligibility
4.1 - When registering to use an Empire Strong Account, certain requirements must be met. First, as an individual, you must be at least 18 years of age or otherwise legally capable of entering into a binding contract under applicable laws. In addition, as an individual, legal entity or organization, you must have full legal capacity and sufficient authorizations to accept the Terms.
4.2 - It is important to note that access to the Empire Strong Platform and Empire Strong Services is limited in some countries and regions, so it is the user's responsibility to be aware of the restrictions and/or requirements in each country. If there are legal restrictions in a particular jurisdiction, some products, services or functionality of the Empire Strong Platform may be limited or not available for use.
4.3 - If you are accessing the Empire Strong Platform and Empire Strong Services on behalf of a legal entity, you must represent and warrant that you have all necessary rights and authorizations to represent such legal entity and access and use the platform on its behalf.
4.4 - Use of the Empire Strong Platform and Empire Strong Services must comply with all applicable laws and regulations, including anti-money laundering, anti-corruption and terrorist financing laws. It is important to remember that Empire Strong Operators have the right to change, modify or impose additional restrictions regarding access and use of the Platform and/or Services at any time, without prior notice.
5. Security
5.1 - The security of funds entrusted by users is guaranteed by Empire Strong, which implements the highest industry standards of protection in its services. However, individual user actions can pose security risks. Therefore, it is crucial that you keep your access credentials, such as your username and password, confidential and do not share them with third parties. It is up to you to take the necessary steps to protect your Empire Strong Account and personal information.
5.2 -It is your responsibility to ensure the security of your Empire Strong Account and password, as well as all transactions conducted through it. Empire Strong is not responsible for losses or consequences caused by the authorized or unauthorized use of your account credentials, such as disclosure of information, consent or submission of agreements by clicking on the website, renewal of agreements online, among others.
5.3 - By creating your Empire Strong Account, you agree to:
- Immediately notify Empire Strong if you become aware of any unauthorized use of your account or breach of security rules;
- Strictly comply with all Empire Strong mechanisms and procedures related to security, authentication, trading, billing and withdrawal;
- Take appropriate steps to exit Empire Strong at the end of each visit.
6. Services
6.1 - By creating your Empire Strong Account, you agree to:
- Offer, change or terminate any Empire Strong Service at its discretion;
- Allow or prohibit certain Users from using any Empire Strong Services, in accordance with the applicable Empire Strong Platform Rules;
- Empire Strong is also the sole authority to determine which Digital Assets are listed on the platform, and may add or remove such assets, in its sole discretion, from time to time. The company can also modify the order size available for each Digital Asset. With regard to these additions, removals or amendments, Empire Strong may, but is not obliged to notify Users in advance and is not responsible to Users in relation to such changes.
7. Fees
7.1 - Exchange Empire Strong is a cryptocurrency trading platform that generates revenue from buying and selling Supported Digital Assets on its website. The company charges fees that vary according to the type of service offered. When using Empire Strong's services, the user agrees to pay all applicable fees, including the spread, if applicable. It is important to note that Empire Strong reserves the right to change its prices and fees, as well as disclaimers, at any time.
7.2 - The company informs the user of the final price of each transaction, including prices and fees, when the transaction is authorized on each issued receipt. Empire Strong bears the bank fees associated with the operations carried out in its system, whether in the transfer of incoming or outgoing funds. However, it is important to remember that you are responsible for paying any additional fees charged by your financial services provider. If bank fees exceed the transfer amount, Empire STRONG will not process the transaction. In this case, the user may be asked to deposit an additional amount in US dollars to cover bank fees and complete the transfer.

It is crucial that the user is aware of his responsibilities for paying any additional fees that may apply, in order to avoid delays or interruptions in his financial operations on the platform.
8. Risk warning
8.1 - Cryptocurrencies have become a popular alternative to traditional financial markets, attracting investors from all over the world. However, as with any form of investing, it is crucial to understand the risks involved.

8.3 - Limited liquidity: Cryptocurrency markets can be less liquid than traditional financial markets, making buying or selling cryptocurrencies at desired prices more difficult. During periods of high volatility, liquidity can become even more limited, which can result in delays or problems executing buy or sell orders.

Protecting login information, passwords and digital wallets from unauthorized access is crucial to the security of your cryptocurrencies. Although Empire Strong takes security measures to protect your information, it is the trader's responsibility to take additional measures to ensure the security of your personal and financial data.
9. Account closure
9.1 - Empire Strong has the right to immediately suspend your account and other related accounts if you suspect a violation of the terms of service, privacy policy or applicable laws. If this happens, they can block your digital assets and funds on all accounts, as well as suspend your access without notice. The company will not be responsible for any permanent or temporary modifications to your account or for the suspension or termination of access to the services. Empire Strong may retain and use transaction data and other information related to your account.
9.2 - In addition, Empire Strong may cancel your account under specific circumstances, including terminating services, registering on behalf of a third party, providing false information or refusing to accept amended terms. If this happens, your account information will be securely stored for 5 years, provided it meets data retention standards. If there are uncompleted transactions during account closure, the company may notify the other party of the situation.
9.3 - In the event Empire Strong receives information that your digital assets or funds have been stolen or otherwise not legally owned, they may place an administrative hold on those funds and your account. The hold may be maintained until the dispute is resolved and evidence of acceptable resolution is provided. The company will not be involved in the resolution of the dispute and will not be responsible for the retention or inability to withdraw digital assets or funds during the retention period.
9.4 - Upon closing an account with Empire Strong, all remaining amounts, including any outstanding fees or obligations, must be immediately paid to the company. After clearing any pending items, users will have up to 5 business days to withdraw their Digital Assets or account funds.
9.5 - If an Empire Strong account is terminated due to fraud, violation of law or the Terms, the company will retain custody of the Digital Assets, funds and user information. This data may be turned over to government authorities during investigations.
9.1 - In relation to dormant accounts, Empire Strong may require the user to close all open positions and withdraw all Digital Assets from the account within 30 days after written notification. If the user fails to comply with this requirement, Empire Strong shall have the right to deem the account inactive, close all open positions, convert the Digital Assets to another type and transfer the inactive account to an affiliate of the company, third party custodian or wallet isolated. The company may charge an inactive account fee and close the account at any time, but will not be responsible for any losses incurred by the user, except in cases of fraud or intentional default. After closing an inactive account, it cannot be reactivated.
10. Absence of financial guidance
10.1 - Empire Strong does not act as your broker, intermediary, agent or adviser and has no fiduciary obligation or relationship to you in connection with any dealings or other activities you engage in using its services. No information or communication provided by Empire Strong should be considered or construed as financial advice, investment advice, trading advice or any other type of advice. All trades are executed automatically, according to the parameters of your order instructions and in accordance with published trade execution procedures.
10.2 - It is up to you to decide whether an investment, investment strategy or related transaction is appropriate for your personal investment objectives, financial circumstances and risk tolerance, and you are solely responsible for any losses or liabilities arising therefrom. It is highly recommended that you consult legal or tax professionals to assess your specific situation.
10.1 - Empire Strong does not endorse or recommend the purchase, sale, gain or holding of any Digital Assets and it is important that you perform your own due diligence and consult your financial advisors before making any investment decisions. Empire Strong is not responsible for the decisions you make based on the information provided by its services regarding the purchase, sale or maintenance of Digital Assets.
11. Compliance with local laws
11.1 - Users of Empire Strong services are responsible for complying with local laws governing the lawful use of these services in their jurisdiction, in addition to other applicable regulations. They should also consider tax, withholding, collection, reporting and appropriate remittance to local tax authorities. It is stated by users that all funds come from legitimate sources and do not involve illegal activities. Empire Strong requires its users to provide or collect information and materials necessary to verify the legality of the sources and use of their funds, in accordance with relevant laws or government orders. The company cooperates with law enforcement authorities around the world and does not hesitate to take legal action, such as seizing, freezing or terminating accounts and funds, if users are flagged or investigated under legal mandate.
12. General Provisions
12.1 - Empire Strong reserves the right to modify, revise, amend and/or update these Terms at any time. All changes will be effective immediately upon posting on the Empire Strong websites. It is the user's responsibility to regularly check the relevant pages on our websites/apps to confirm the most recent version of these Terms. If the user does not agree with the changes, the only option is to terminate the use of Empire Strong services and cancel the account. It is agreed that, unless expressly provided otherwise in these Terms, Empire Strong shall not be liable for any modification or termination of the Empire Strong services by you or any third party, or suspension or termination of your access to the Empire Strong services.
12.2 - Empire Strong reserves the exclusive and absolute right to translate this Term into a language other than Portuguese. By agreeing to this, you understand that the translation on the website is for your convenience only and that the Portuguese text will prevail in case of ambiguity, discrepancy or omission between the Portuguese text and any translated text.
12.3 - Empire Strong cannot be held responsible for delays or failure to comply with the agreed Terms if these are caused by conditions beyond its reasonable control.
12.4 - If any part of these Terms is held to be invalid or unenforceable, that condition will not affect the other provisions of these Terms, which will remain in full force and effect. The invalid or unenforceable portion will be effective to the maximum extent permitted by law.
12.5 - Assignment or transfer of any rights to use Empire Strong's Services, or any rights or obligations under these Terms, without Company's prior written consent is prohibited. This includes any rights or obligations related to law enforcement or change of control. Empire Strong may assign or transfer all or some of its rights or obligations under these Terms, in whole or in part, without prior notice or user consent.
12.6 - A party's failure to enforce any provision will not affect that party's right to enforce any subsequent time. Likewise, a waiver by a party to seek recovery for a breach of these Terms or any provision of the applicable terms by the other party will not be deemed a waiver by that party of any subsequent breach by the other party or the provision itself.
12.7 - Any link to third party sites from the Empire Strong Services does not imply endorsement by the company of any product, service, information or disclaimer presented therein. Empire Strong does not guarantee the accuracy of the information contained on these third party websites, and if you suffer any loss while using these third party products or services, Empire Strong will not be responsible for that loss. Furthermore, as Empire Strong has no control over the terms of use or privacy policies of third-party websites, it is important that you read and understand these policies carefully.
